Business Litigation

Mr. Liberto is a litigation attorney with over 20 years experience representing business and individual interests in state and federal court. Issues include contract disputes, debt collection, real estate title disputes and fraud. Mr. Liberto has developed sub-areas of specialty that focus on Internet issues such as domain name disputes, Web site development, the Online Copyrights Liability Limitations Act, and the Digital Millennium Copyright Act. Representation includes case assessment, initiation of proceedings and initial response, all phases of discovery, settlement, trial and judgment execution.

In the area of enterprise liability, Mr. Liberto successfully recovered a substantial debt owed to the American National Red Cross by a blood clinic. The clinic attempted to escape liability by abusing Chapter 7 bankruptcy relief by reincorporating after bankruptcy. Read article here

Business Transactions

Mr. Liberto has represented individual and corporate interests in transactions including negotiations and document preparation for addressing a full range of subjects including commercial transactions, purchase and sale of businesses, software incensing, real estate sales and executive employment agreements. He has also counseled and guided the formation of partnerships, limited partnerships, limited liability companies and corporations.

Dispute Resolution, Arbitration and Mediation (ADR)

Mr. Liberto is a trained expert in ADR methods who has successfully mediated and arbitrated business disputes both domestically and internationally. He was hired by the World Bank International Finance Corporation (IFC) to assess the institutionalization of commercial mediation in the Kingdom of Morocco. He also represented a large Algerian bottling company in a franchise dispute against large renown soft drink companies in arbitration before the International Chamber of Commerce in Paris.
